Service Description

Pennsylvania Pest Control provides professional pest management and extermination services to residential and commercial clients throughout the Commonwealth of Pennsylvania. Our services include, but are not limited to, inspection for pest activity, identification of pest species, implementation of treatment plans, application of pesticides and integrated pest management solutions, exclusion work to prevent pest entry, monitoring and follow-up visits, and consultation on sanitation and prevention practices. We treat for common Pennsylvania pests including termites, carpenter ants, bed bugs, rodents, cockroaches, spiders, wasps, bees, fleas, ticks, mosquitoes, and wildlife intrusions. Specific treatment methods, products used, and service frequency will be determined based on individual property conditions, pest pressures, and the terms outlined in your signed service agreement. All services are performed by licensed applicators in accordance with Pennsylvania Department of Agriculture regulations and applicable federal pesticide laws. We reserve the right to modify our service offerings, treatment protocols, and product selections at any time to maintain compliance with evolving regulations, safety standards, and industry best practices.

No Guarantee or Warranty

Pennsylvania Pest Control makes no express or implied guarantees regarding the complete elimination of pests from any treated property. Pest control outcomes depend upon numerous factors beyond our reasonable control, including but not limited to: pre-existing structural conditions that allow pest entry; neighboring properties with untreated infestations; client compliance with sanitation and preparation recommendations; environmental conditions conducive to pest activity; pesticide resistance in target pest populations; and the biological behaviors of particular pest species. We do not warrant that treatments will prevent future infestations or that treated areas will remain pest-free indefinitely. Any retreatment services provided under a maintenance agreement are subject to the specific terms and conditions of that agreement. Our liability for any service performed is strictly limited to re-treatment or refund of fees paid for the specific unsatisfactory service, at our sole discretion. No other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, are provided.

User Responsibilities

Clients must provide accurate information about property conditions, prior pest control treatments, chemical sensitivities of occupants, and presence of pets, children, or vulnerable individuals. You must follow all preparation instructions provided before scheduled services, which may include moving furniture, removing food items, securing pets, and vacating premises during treatment and specified re-entry intervals. Failure to comply with preparation requirements may result in service rescheduling with applicable fees. Clients are responsible for maintaining structural integrity of their properties, including sealing cracks, repairing screens, addressing moisture issues, and eliminating food sources that attract pests. You must promptly report any adverse reactions, pest activity persistence, or property damage concerns following treatment. Access to all areas requiring treatment must be provided at scheduled appointment times; repeated lockouts or access denials may result in termination of services. Payment is due according to the terms specified in your service agreement, and late payments may incur fees or result in service suspension.

Limitation of Liability

To the maximum extent permitted by applicable law, Pennsylvania Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to our services, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof. Our total cumulative liability for any claim related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the event. We expressly disclaim liability for damage to personal property, structural damage, health effects on occupants or pets, or business interruption resulting from pest activity, treatment application, or failure of treatments to achieve desired outcomes. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. You acknowledge that pest control involves inherent uncertainties and that our pricing reflects the allocation of risk described herein.

Intellectual Property

All content, materials, and intellectual property associated with Pennsylvania Pest Control, including but not limited to our business name, logos, service marks, trade dress, website content, photographs, technical documents, treatment protocols, and proprietary methodologies, are our exclusive property or licensed to us. No license or right to use any of our intellectual property is granted by these Terms of Service or by your engagement of our services. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our intellectual property without prior written consent. Client testimonials or photographs of treated properties provided to us may be used for marketing purposes unless you expressly object in writing. Technical information and recommendations provided during service consultations are for your personal use only and may not be disclosed to competing pest control operators or used to circumvent our services.

Governing Law

These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any legal action or proceeding related to our services must be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of such courts. You waive any objection to venue in these courts. The provisions of these terms are severable, and if any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any breach or default shall constitute a waiver of any subsequent breach or default. These terms constitute the entire agreement between you and Pennsylvania Pest Control regarding the subject matter herein and supersede all prior agreements, understandings, and representations.

Changes to Terms

Pennsylvania Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason. Material changes will be communicated to active clients via the contact information on file, and revised terms will be posted on our website with the updated effective date. Your continued engagement of our services following notification of changes constitutes acceptance of the modified terms. If you do not agree to the revised terms, you must discontinue services and notify us in writing. Changes will not apply retroactively to services already performed but will govern all future service engagements. We encourage you to review these terms periodically to remain informed of your rights and obligations.
